The Patent Trial and Appeal Board (PTAB) of the United States Patent and Trademark Office (USPTO) has announced that its Final Rule regarding changes to trial practice under the America Invents Act (AIA) published in the Federal Register today. This Final Rule addresses the claim construction approach for AIA trials involving soon-to-be expired patents, testimonial evidence that may be submitted with a patent owner’s preliminary response, Rule 11-type certification, and word count for major briefing.
